General

Under Article 13 of the Swiss Federal Constitution and the federal data protection legislation (Swiss Federal Act on Data Protection, DSG), everyone has the right to have their privacy protected and to be protected against the misuse of their personal data. The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection provisions and this privacy policy.

Together with our hosting providers, we endeavour to protect the databases as effectively as possible against unauthorised access, loss, misuse or falsification.

We would point out that the transmission of data on the internet (e.g. when communicating by e-mail) may have security gaps. Complete protection of data against access by third parties is not possible.

By using this website, you consent to the collection, processing and use of data as described below. As a matter of principle, this website can be visited without registration. Data such as the pages accessed or the names of the files accessed, the date and the time are stored on the server for statistical purposes without this data being related directly to your person. Where personal data (for example name, address or e-mail addresses) is collected on our pages, this is always done on a voluntary basis as far as possible. This data is not passed on to third parties without your express consent.

Processing of personal data

Personal data is any information relating to an identified or identifiable person. A data subject is a person about whom personal data is processed. Processing covers any handling of personal data, irrespective of the means and procedures used, in particular the storage, disclosure, obtaining, erasure, retention, alteration, destruction and use of personal data.

We process personal data in accordance with Swiss data protection law. Where and to the extent that the EU GDPR is applicable, we also process personal data on the following legal bases in conjunction with Art. 6 (1) GDPR:

  • lit. a) Processing of personal data with the consent of the data subject.
  • lit. b) Processing of personal data for the performance of a contract with the data subject and for carrying out corresponding pre-contractual measures.
  • lit. c) Processing of personal data for compliance with a legal obligation to which we are subject under applicable EU law or under the applicable law of a country in which the GDPR applies in whole or in part.
  • lit. d) Processing of personal data in order to protect the vital interests of the data subject or of another natural person.
  • lit. f) Processing of personal data in order to safeguard the legitimate interests of ourselves or of third parties, unless the fundamental freedoms and the rights and interests of the data subject override them. Legitimate interests include, in particular, our business interest in being able to provide our website, information security, the enforcement of our own legal claims and compliance with Swiss law.

We process personal data for as long as is necessary for the respective purpose or purposes. Where longer retention obligations arise from statutory and other obligations to which we are subject, we restrict the processing accordingly.

Cookies

This website uses cookies — small text files stored in the browser. There are three:

  • fe_typo_user: set by the TYPO3 content management system, for the duration of the session only and without any analysis. It is needed for the pages to work.
  • _ga and _ga_KZL9HNX8HS: set by Google Analytics, with a lifetime of about two years. They serve audience measurement — see the section «Google Analytics 4».

Cookies can be switched off or deleted in the browser. The website remains usable; only the audience measurement stops.

With SSL/TLS encryption

For security reasons and in order to protect the transmission of confidential content, such as enquiries you send to us as the site operator, this website uses SSL/TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from «http://» to «https://» and by the padlock symbol in your browser line.

When SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Server log files

The provider of this website automatically collects and stores information in what are known as server log files, which your browser transmits to us automatically. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request

This data cannot be attributed to specific persons. This data is not merged with other data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of unlawful use.

Third-party services

Two third-party services are contacted when this website is visited:

  • Google Analytics on all pages, for audience measurement.
  • Friday Snap on the «Impressions» page, for the photo album.

Each of these has its own section below. Nothing else is loaded from outside servers: the typefaces sit on our own server, there is no advertising, no social network buttons and no Google reCAPTCHA. The arithmetic task in our forms is generated by the form system itself — no data leaves our server in the process.

Forms

This website carries three forms:

  • Registration for theatre groups — details about the group, the play and the contact person.
  • Survey — feedback on the festival.
  • Membership of the supporting association — name, address and e-mail, optionally telephone number and a comment, plus the chosen type of membership.

The details are sent by e-mail to the responsible people of the association. Anyone registering or joining the association also receives a confirmation at the e-mail address given. We use the details to deal with the request and do not pass them on to third parties.

There is no contact form as such. For questions, the addresses are in the footer of every page.

Right to confirmation

Every data subject has the right to request confirmation from the operator of the website as to whether personal data concerning them is being processed. If you would like to exercise this right to confirmation, you can contact the data protection officer at any time.

Right of access

Every person affected by the processing of personal data has the right to obtain from the operator of this website, at any time and free of charge, information about the data stored about them and a copy of this information. In addition, information may be provided about the following:

  • Purposes of the processing
  • Categories of personal data processed
  • Recipients to whom the personal data has been or will be disclosed
  • where possible, the envisaged period for which the personal data will be stored or, if this is not possible, the criteria used to determine that period
  • the existence of a right to rectification or erasure of the personal data concerning them, or to restriction of processing by the controller, or a right to object to such processing
  • the existence of a right to lodge a complaint with a supervisory authority
  • where the personal data is not collected from the data subject: any available information about the origin of the data.

In addition, the data subject has the right to be informed whether personal data has been transferred to a third country or to an international organisation. If this is the case, the data subject also has the right to be informed of the appropriate safeguards relating to the transfer. If you would like to make use of this right of access, you can contact our data protection officer at any time.

Right to rectification

Every person affected by the processing of personal data has the right to request the immediate rectification of inaccurate personal data concerning them. In addition, taking into account the purposes of the processing, the data subject has the right to request that incomplete personal data be completed – including by means of a supplementary statement. If you would like to exercise this right to rectification, you can contact our data protection officer at any time.

Right to erasure

Every person affected by the processing of personal data has the right to request that the controller of this website erase without delay the personal data concerning them, provided that one of the following grounds applies and the processing is no longer necessary:

  • The personal data was collected or otherwise processed for purposes for which it is no longer necessary.
  • The data subject withdraws the consent on which the processing was based and there is no other legal basis for the processing
  • The data subject objects to the processing on grounds relating to their particular situation and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing in the case of direct marketing and the associated profiling
  • The personal data has been processed unlawfully
  • The erasure of the personal data is necessary for compliance with a legal obligation under Union law or the law of the Member States to which the controller is subject
  • The personal data was collected in relation to information society services offered directly to a child

If one of the above grounds applies and you would like to arrange for the erasure of personal data stored by the operator of this website, you can contact our data protection officer at any time. The data protection officer of this website will arrange for the erasure request to be complied with without delay.

Right to restriction of processing

Every person affected by the processing of personal data has the right to request the controller of this website to restrict the processing if one of the following conditions is met:

  • The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data
  • The processing is unlawful, the data subject objects to the erasure of the personal data and requests instead the restriction of the use of the personal data
  • The controller no longer needs the personal data for the purposes of the processing, but the data subject requires it for the establishment, exercise or defence of legal claims
  • The data subject has objected to the processing on grounds relating to their particular situation, and it has not yet been established whether the legitimate interests of the controller override those of the data subject.

If one of the above conditions is met, you can contact our data protection officer at any time in order to request the restriction of the processing of personal data by the operator of this website. The data protection officer of this website will arrange for the processing to be restricted.

Right to data portability

Every person affected by the processing of personal data has the right to receive the personal data concerning them in a structured, commonly used and machine-readable format. In addition, the data subject has the right to have the personal data transmitted directly from one controller to another controller, provided that this is technically feasible and does not adversely affect the rights and freedoms of other persons. In order to assert the right to data portability, you can contact the data protection officer appointed by the operator of this website at any time.

A right to object

Every person affected by the processing of personal data has the right to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them.

In the event of an objection, the operator of this website will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or unless the processing serves the assertion, exercise or defence of legal claims. In order to make use of your right to object, you can contact the data protection officer of this website directly.

Right to withdraw consent under data protection law

Every person affected by the processing of personal data has the right to withdraw consent given to the processing of personal data at any time. If you would like to make use of your right to withdraw consent, you can contact our data protection officer at any time.

Copyright

The copyright and all other rights to the content, images, photographs or other files on the website belong exclusively to the operator of this website or to the rights holders named. The written consent of the copyright holders must be obtained in advance for the reproduction of any files. Anyone who commits a copyright infringement without the consent of the respective copyright holder may be liable to prosecution and may, in certain circumstances, face claims for damages.

Google Analytics 4

This website uses Google Analytics 4, an audience measurement service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The measurement ID is G-KZL9HNX8HS. The script is delivered by www.googletagmanager.com; we do not use Google Tag Manager.

What is recorded: which pages are opened, for how long, with which device, from which region and via which referring page. The cookies _ga and _ga_KZL9HNX8HS serve this purpose. We want to know which content is being looked for — not who is looking for it. Google Analytics 4 does not store IP addresses; they only serve to determine the region roughly and are then discarded.

We evaluate the figures in aggregate only. They are not combined with other data, and no advertising is served on this website.

The legal basis is our overriding interest in understanding how our offering is used (Swiss Data Protection Act; where the GDPR applies, Art. 6(1)(f) GDPR). Anyone who does not want this measurement can switch the cookies off in the browser or install Google's browser add-on to opt out of Google Analytics: tools.google.com/dlpage/gaoptout.

Google may transfer data to the USA in the process — see the section «Data transfer to the USA».

Photo album «Friday Snap»

On the «Impressions» page, a photo album from the Friday Snap service (app.friday-snap.ch) is embedded as a window. Opening that page establishes a connection to the provider's servers, before anyone clicks on a picture. Technical details are transmitted in the process: IP address, browser and operating system, time of access and the referring page.

Friday Snap loads the pictures from a Cloudflare store located in Europe and uses the Sentry service, located in Germany, to record technical errors. We have no influence on the appearance or content of this window.

Anyone wishing to avoid this connection does not open the «Impressions» page. The other pages are unaffected.

Links to other sites

In the footer and in the content of this website there are links to other sites: to our presences on Facebook, Instagram, YouTube, LinkedIn and TikTok, to Google Maps for directions to the venues, and to the sites of theatre groups, sponsors and partners.

These are ordinary links, not embedded content: neither buttons nor counting pixels of these providers are loaded. As long as nobody clicks on them, none of these providers learns anything about your visit.

Anyone following a link leaves our website. From then on the privacy policy of the respective provider applies; we cannot answer for the content or the behaviour of other sites.

Ticket sales via Ticketpark

Tickets for the Volkstheaterfestival Meiringen are sold through the ticketing platform of Ticketpark GmbH, Bern (www.ticketpark.ch). On the «Tickets» page, the Ticketpark sales window is embedded as an iFrame.

When that page is opened, a connection to Ticketpark’s servers is established. Technical data is transmitted in the process, in particular the IP address, details of the browser and operating system, the selected language, the time of access and the referring page. During the purchase, Ticketpark may set cookies that are necessary to complete it. We have no influence on the appearance or the content of that window.

Anyone buying a ticket enters their title and name, postal address, e-mail address and telephone number in the Ticketpark window; depending on the event, further details may be added. Ticketpark processes this data on behalf of the Volkstheaterfestival Meiringen. Responsibility for the processing lies with us, not with the provider. We use the details to complete the purchase, for admission and, where wanted, for information about the festival.

Details of the processing by Ticketpark are set out in the privacy policy for ticket buyers and in the general Ticketpark privacy policy; the subprocessors used are listed there.

Anyone who wishes to avoid the connection to Ticketpark should not open the «Tickets» page and can buy tickets at the box office instead.

Data transfer to the USA

With Google Analytics, this website includes the service of a company based in the USA. Data may be transferred to servers in the USA in the process.

Such transfers used to rest on the Privacy Shield. The Court of Justice of the European Union declared it invalid on 16 July 2020 in the «Schrems II» judgment, because US surveillance law offers neither equivalent protection nor an effective legal remedy. The Swiss Federal Data Protection and Information Commissioner stated on 8 September 2020 that the Swiss-US Privacy Shield no longer provided adequate protection either.

A new framework has applied since: the European Union recognised the EU-US Data Privacy Framework on 10 July 2023, Switzerland the Swiss-US Data Privacy Framework on 14 August 2024, in force since 15 September 2024. Certified US companies — Google LLC among them — thereby count as recipients in a country with adequate data protection. In addition, we rely on the standard contractual clauses.

We point out that even under these frameworks US authorities may access data under certain conditions, and that such processes are beyond our influence.
